APPOINTMENT OF CHAIR

Minutes:

Resolved:     That Councillor Graham Hutton be appointed as Chair for this

meeting.

4.

DISCLOSURE OF EXEMPT INFORMATION

To resolve that the public be excluded from the meeting during consideration of the following items because it is likely that there will be disclosure of exempt information as defined in paragraphs 1, 2 and 7 in Part 1 of Schedule 12A of the Local Government Act 1972.

consideration if the following matter because it is likely that there will be disclosure of exempt information as defined in paragraphs 1,2 and 7 contained within Part 1 of Schedule 12A of the Local Government Act, 1972

Local Government (Miscellaneous Provisions) Act - 1976 - DRIVER KMO

The Committee considered an application from Mr KMO for a Private Hire Vehicle Licence and requested to be exempt for the requirement to display door signs and external Private Hire plates that would normally fall outside of the policy.

 

In determining the application the committee considered their policy, the officers report and Mr KMO addressed the Committee.

 

 

Resolved:     That the exemption would apply only when the vehicle was:-

 

(i)            Being used to carry out executive airport transfers

(ii)          Carrying business class clients

 

The following conditions would be added to the licence:-

 

(i)            The vehicle licence must be clearly displayed on the dashboard at all times

(ii)          The driver must wear his private hire drivers badge at all times

 

At all other times the vehicle must be plated.

 

6.

Local Government (Miscellaneous Provisions) Act - 1976 - DRIVER HR

The Committee considered a report regarding a current Dual Hackney Carriage and Private Hire Driver, Mr HR to have his licence reviewed following a previous decision of this Committee.

 

Resolved:     That the licence be allowed to continue until its expiry on 14

February, 2022.

Local Government (Miscellaneous Provisions) Act - 1976 - DRIVER DJ

The Committee considered a report regarding a complaint made against Mr DJ.

 

Mr DJ was accompanied by Mr TC who spoke on his behalf.

 

Mr TC gave an explanation of the offence which was accepted by the Committee. Medical evidence was also produced.   

 

Resolved:     That, Mr DJ’s licence be allowed to continue but that he

be issued with a written warning as to his future conduct.

Local Government (Miscellaneous Provisions) Act - 1976 - DRIVER SA

The Committee considered a report concerning Mr SA who holds a Dual Hackney Carriage and Private Hire Driver licence.  Mr SA had received a conviction which fell within the Councils guidelines for the relevance of convictions.  Mr

 

Mr SA was given the opportunity to address the Committee.

 

Mr SA gave an explanation which was accepted by the Committee and apologised for his offence.

 

Resolved:     That, Mr SA’s licence be allowed to continue but that he

be issued with a written warning as to his future conduct.

Local Government (Miscellaneous Provisions) Act - 1976 - DRIVER SH

The Committee considered a report concerning Mr SH who holds a Dual Hackney Carriage and Private Hire Driver licence.  Mr SH had received a conviction which fell within the Councils guidelines for the relevance of convictions.  Complaints had also been made against Mr SH.

 

Mr SH was given the opportunity to address the Committee.

 

The Committee listened to the circumstances surrounding the offence and complaints against Mr SH.

 

Resolved      That the licence of Mr SH be suspended for a period of four weeks.

To consider any business which is urgent within the meaning of Section 100(B)4 of the Local Government Act.
