DISCLOSURE OF EXEMPT INFORMATION

To resolve that the public be excluded from the meeting during consideration of the attached report, because it is likely that there will be disclosure of exempt information as defined in paragraphs 1, 2 and 7 in Part 1 of Schedule 12A of the Local Government Act 1972.

Local Government (Miscellaneous Provisions) Act - 1976

The Committee considered a report regarding an application for the renewal of a Private Hire Vehicle Licence by Mr MW.

 

The application was outside of the Council’s current Licensing Policy.

 

Mr MW was represented by Mr GC who spoke on his behalf.  The information was considered by the Members.

 

The Chair stated that, whilst Mr MW was unaware of the vehicle’s status, it was the Council’s Policy.  Nothing had been put to the Committee to suggest that they should depart from the Policy and there was also the safety element.

 

Resolved:     That the application to renew the Private Hire Vehicle Licence for Mr MW be refused on the grounds of public safety.

Local Government (Miscellaneous Provisions) Act - 1976

The Committee considered a report regarding an application for the renewal of a Dual Hackney Carriage and Private Hire Driver’s Licence by Mr AB.

 

The application form had revealed a conviction which fell within the Council’s guidelines.

 

Mr AB was given the opportunity to address the Committee.  The information was considered by the Members.

 

Mr AB stated that the omission of information was a genuine error.

 

Resolved:     That the application to renew the Dual Hackney Carriage and

Private Hire Driver’s Licence for Mr AB be granted with a warning that, it was his responsibility to know the Council’s Policy and to ensure that any forms submitted in the future were completed correctly.

Local Government (Miscellaneous Provisions) Act - 1976

Driver – Mr DP

The Committee considered a report regarding an application for a new Private Hire Vehicle Licence by Mr DP.

 

Mr DP wished to be exempted from displaying door signs and external Private Hire Plates.

 

Resolved:     That the application to depart from the Council’s Policy to display

external door signs and plates be granted when the vehicle is being used for executive travel.  The driver is to be requested to wear ID at all times.

 

At all other times, the vehicle is to be plated and ID displayed inside the vehicle.  In addition, the letter of exemption and the plates are to be kept in the vehicle.

The Committee considered a report regarding a new application for an Operator Licence by SC which had revealed a conviction.

 

Mr KH was given the opportunity to address the Committee.  The information was considered by the Members.

 

Mr KH stated that the omission had been a genuine mistake and apologised for the error.

 

Resolved:     That the application for an Operator Licence be granted.

To consider any business which is urgent within the meaning of Section 100(B)4 of the Local Government Act.
