DISCLOSURE OF EXEMPT INFORMATION

To resolve that the public be excluded from the meeting during consideration of the attached report, because it is likely that there will be disclosure of exempt information as defined in paragraphs 1, 2 and 7 in Part 1 of Schedule 12A of the Local Government Act 1972.

Resolved:-                That the public be excluded from the meeting during

consideration if the following matter because it is likely that there will be disclosure of exempt information as defined in paragraphs 1,2 and 7 contained within Part 1 of Schedule 12A of the Local Government Act, 1972

LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT - 1976 - APPLICANT 1

 The Sub-Committee considered an application for a Dual Hackney Carriage and Private Hire Driver’s licence.  The application was before the Sub-Committee as the application process had revealed matters that fell outside the Council’s Licensing Policy.

 

After careful consideration of information from the Council’s Licensing Officer and representations from the applicant and their representative, the Sub-Committee agreed as follows:

 

Resolved:     That the application be accepted as a renewal application and that this be granted with a warning. The driver was advised that it was his responsibility to ensure that all documents were completed and submitted on time, with all clauses completed.

LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT - 1976 - APPLICANT 2

The Sub-Committee considered a matter relating to a Dual Driver Licence.

 

After very careful consideration of information from the Council’s Licensing Officer and representations from the applicant, the Sub-Committee agreed as follows:

 

Resolved:     That the Driver be issued with a warning as to future conduct.  The driver was also informed that it was his responsibility to ensure that the Council’s Taxi Licensing Policy was taken seriously and that all conditions were adhered to.

The applicant had requested that his application be deferred to the 9 February meeting.

 

Resolved:     That the application be deferred to the next meeting.

The Sub-Committee considered a new application for a Hackney Carriage Vehicle licence.  The application was before the Sub-Committee as the application process had revealed a matter that fell outside the Council’s Licensing Policy.

 

After careful consideration of information from the Council’s Licensing Officer and representations from the applicant, the Sub-Committee agreed as follows:

 

Resolved:     That the application be considered as a new application and that the application be refused on the grounds that the vehicle did not meet the criteria as set out in the Council’s Policy.  The Sub-Committee did not see any reason to depart from the Policy.  In addition, it was felt that the driver was not a fit and proper person to hold a proprietor licence, as set out in legislation, failing to ensure that the vehicle was fully maintained.
