DISCLOSURE OF EXEMPT INFORMATION

To resolve that the public be excluded from the meeting during consideration of the attached report, because it is likely that there will be disclosure of exempt information as defined in paragraphs 1, 2 and 7 in Part 1 of Schedule 12A of the Local Government Act 1972.

Local Government (Miscellaneous Provisions) Act - 1976 - HK

The Sub Committee considered the question of whether an application for a Dual Hackney Carriage and Private Hire Drivers licence should be renewed.

 

The question arose because the Council had previously suspended the dual driver’s licence for a period of two months and determined that the renewal application must be referred to the Sub-Committee for decision.  

 

The previous suspension was due to various factors including non-compliance with Council policy in relation to notification of offences, previous written warnings in relation to conduct and a history of motoring offences.

 

After very careful consideration of information from the Council’s Licensing Officers and representations received from the applicant, the Sub Committee agreed

 

Resolved: that the application to renew the Dual Hackney Carriage and Private Hire Driver’s licence be refused.

The Sub Committee an application for the renewal of a Dual Hackney Carriage and Private Hire Driver’s licence.

 

The question arose because the application process revealed behaviour and convictions that fell within the Council’s guidelines for the relevance of convictions.    

 

After very careful consideration of information from the Council’s Licensing Officers and representations received from the applicant and his representative, the Sub Committee agreed:

 

Resolved: that the application to renew the Dual Hackney Carriage and Private Hire Driver’s licence be refused.

The Sub Committee considered the question of whether an application for a Dual Hackney Carriage and Private Hire Drivers licence should be renewed.

 

The question arose because the application process revealed convictions that fell within the Council’s guidelines for the relevance of convictions.    

 

After very careful consideration of information from the Council’s Licensing Officers and representations from the applicant, the Sub-Committee agreed:

 

Resolved: that the current licence be suspended and the renewal application be refused.  The applicant be advised to complete the Newcastle under Lyme Borough Council Knowledge Test at which point the Sub-Committee will be minded to reconsider the renewal application.

The Sub-Committee considered a current Dual Driver licence holder who was appearing before them on the grounds that several complaints had been received about him.       

 

During the meeting, the licence holder’s solicitor requested that it be placed on record that he objected to questions raised of the licence holder.  His objection was not upheld by the Sub-Committee.

 

After very careful consideration of information from the Council’s Licensing Officers and representations received from the licence holder and his representative, the Sub Committee agreed:

 

Resolved: that the licence holder be issued with a final warning and should any further complaints be received then the matter will be brought back before this Sub-Committee.

The Sub-Committee considered a new application for a Hackney Carriage Vehicle Licence.  The matter was brought before the Sub-Committee as the vehicle did not meet the criteria for New Hackney Carriage Vehicle licences as it had lost its Grandfather Rights and was not directly replacing another vehicle with Grandfather Rights. 

 

After very careful consideration of information from the Council’s Licensing Officers and representations received from the applicant, the Sub Committee agreed:

 

Resolved: that the application for a Hackney Carriage Vehicle Licence be refused on the grounds that the application does not comply with the Council’s Taxi Licensing Policy 2019-2021.

To consider any business which is urgent within the meaning of Section 100(B)4 of the Local Government Act.
