DISCLOSURE OF EXEMPT INFORMATION

To resolve that the public be excluded from the meeting during consideration of the attached report, because it is likely that there will be disclosure of exempt information as defined in paragraphs 1, 2 and 7 in Part 1 of Schedule 12A of the Local Government Act 1972.

Local Government (Miscellaneous Provisions) Act - 1976

The Committee considered a report regarding an application for the renewal of a Dual Hackney Carriage and Private Hire Driver’s Licence by Mr BA.

 

The application form had shown discrepancies and had omitted information which was relevant to the application.

 

Mr BA was represented by Mr GC who spoke on his behalf.  The information was considered by the Members.

 

Mr BA stated that the omission of information was a genuine error.

 

The Chair stated that it was Mr BA’s duty to notify the Council within 72 hours of committing an offence and that this must be in writing/email as opposed to a telephone call.  In addition, the applicant was advised to note down all past convictions for future reference.

 

Resolved:     That the application to renew the Dual Hackney Carriage and

Private Hire Driver’s Licence for Mr BA be granted with a warning that, should there be any further offences he would be brought back in front of this Committee.

Local Government (Miscellaneous Provisions) Act - 1976

The Committee considered a report regarding an application for the renewal of a Dual Hackney Carriage and Private Hire Driver’s Licence by Mr EH.

 

The application form had shown discrepancies and had omitted information which was relevant to the application.

 

Mr EH was given the opportunity to address the Committee.  The information was considered by the Members.

 

Mr EH stated that the omission of information was a genuine error.  In addition he stated that he had read the Council’s Policy and Guidelines but did not fully understand them.

 

Resolved:     That the application to renew the Dual Hackney Carriage and

Private Hire Driver’s Licence for Mr EH be granted for a period of nine months, during which time he must take and pass the Knowledge Test. 

 

Once a certificate had been received by the Licensing Department, the remainder of the three year period would be granted administratively, together with a warning that all future submitted documentation must be completed fully and correctly.

The Committee considered a report regarding an application for the renewal of a Dual Hackney Carriage and Private Hire Driver’s Licence by Mr FW.

 

The application form had shown discrepancies and had omitted information which was relevant to the application.

 

Mr FW was represented by Mr GC who spoke on his behalf.  The information was considered by the Members.

 

Mr FW had not responded to a letter which had invited him to do so in connection with the offence.

 

Resolved:     That the application to renew the Dual Hackney Carriage and

Private Hire Driver’s Licence for Mr FW be granted for a period of twelve months, after a four week suspension, together with a warning as to future conduct.

 

Subject to there being no further offences committed, the remainder of the three year period would be granted administratively.

Mr MW was in attendance.  However, as he was unable to un-mute his device and would therefore be unable to participate, the Sub-Committee took the decision to defer this application to the next meeting in the interest of fairness.

The Committee considered a report regarding an application for the renewal of a Dual Hackney Carriage and Private Hire Driver’s Licence by Mr WUR.

 

The application form had shown discrepancies and had omitted information which was relevant to the application.

 

Mr WUR’s application had been brought to the last meeting of this Committee but had been deferred to await the result of an ongoing investigation.

 

Mr WUR was represented by Mr GC who spoke on his behalf.  The information was considered by the Members.

 

Mr BA stated that the omission of information was a genuine error.

 

Resolved:     That the application to renew the Dual Hackney Carriage and

Private Hire Driver’s Licence for Mr WUR be granted for a period of twelve months, commencing after a four week suspension.  

 

Subject to there being no further complaints or convictions, the remainder of the three years would be granted administratively.
