The Chief Executive outlined the process for the meeting which was being held under the Council’s Emergency Procedure.  In accordance with this procedure he would make the decision on each application in consultation with Councillors Hutton and Olszewski.  Officers were in attendance from the Legal Department and Licensing Section. Also in attendance was an officer from IT for the purposes of providing technical support. 

 

The meeting was being held using video conferencing.  All applicants had been given the opportunity to participate using audio or video technology.  The applicant had declined the option of attending by audio or video conference.

 

The Chief Executive considered the question of whether a new application for a Dual Hackney Carriage and Private Hire Drivers licence should be granted.

 

The question arose because it had come to the Council’s attention during the application process that the applicant had a number of convictions from 2017, 2014 and 2011 along with a reprimand; these being matters that fell within the Council’s guidelines for the relevance of convictions.

 

In addition, the application process had revealed a number of penalty points on the applicant’s licence. 

 

After very careful consideration of information from the Council’s Licensing Officers and consultation with Members, the Chief Executive decided as follows:

 

Resolved: that the application for a new Dual Hackney Carriage and Private Hire Drivers licence be refused.

The Chief Executive outlined the process for the meeting which was being held under the Council’s Emergency Procedure.  In accordance with this procedure he would make the decision on each application in consultation with Councillors Hutton and Olszewski.  Officers were in attendance from the Legal Department and Licensing Section. The applicant and his representative attended via audio conference.

 

The Chief Executive considered the question of whether or not to renew a vehicle application that fell outside of the new Council Taxi Licensing Policy and did not meet the vehicle specifications in relation to the colour of the vehicle.

 

After very careful consideration of information from the Council’s Licensing Officers and representations from the applicant and his representative, and consultation with Members the Chief Executive decided as follows:

 

Resolved: that the application for renewal of the vehicle licence be granted.

The Chief Executive outlined the process for the meeting which was being held under the Council’s Emergency Procedure.  In accordance with this procedure he would make the decision on each application in consultation with Councillors Hutton and Olszewski.  Officers were in attendance from the Legal Department and Licensing Section. Also in attendance was an officer from IT for the purposes of providing technical support. 

 

The applicant attended via audio link.

 

The Chief Executive considered an application for a renewal of a Private Hire Driver’s Vehicle licence.

 

The question arose because it had come to the Council’s attention during the application process that the proprietor had a conviction that fell within the Council’s guidelines for relevance of convictions. 

 

The Head of Environmental Health clarified that the applicant was a licensed driver and the application related to the vehicle only.  The new Council policy meant that the proprietor of vehicles now had to satisfy the criteria and any decision against the Vehicle licence may mean the Driver’s licence would require reconsideration. 

 

The Chief Executive gave very careful consideration to the information from the Council’s Licensing Officers and representations from the applicant made via audio link.  He consulted Members present.  The Chief Executive decided that, as the reasons discussed at the meeting were not central to the Vehicle Licence, in that they did not affect the roadworthiness, and because there was no indication that the vehicle would be used for illegal purpose, the application should be approved.

 

Resolved: that the application for the renewal of a Private Hire Driver’s Vehicle licence be granted.

After very careful consideration of information from the Council’s Licensing Officers and the applicant, and consultation with Members, the Chief Executive decided as follows:

 

Resolved: that the application for a Private Hire Vehicle Drivers licence be granted.
