To resolve that the public be excluded from the meeting during consideration of the following items as it is likely that there will be disclosure of exempt information as defined in paragraphs 1, 2 and 7 in Part 1 of Schedule 12A of the Local Government Act 1972.

Local Government (Miscellaneous Provisions) Act - 1976 - DRIVER SHK

The Head of Environmental Services submitted a report concerning an application from driver SHK for a new Dual Hackney Carriage and Private Hire Drivers Licence. Driver SHK attended committee and explained the circumstances surrounding the convictions which had been revealed on the Disclosure and Barring Service certificate.

 

Whilst the Committee took any possible issue of dishonesty very seriously members were mindful to accept the explanation which was given.

 

Resolved:     That driver SHK be issued with a licence for a period of 1 year, to be renewed administratively, following receipt of satisfactory DBS and DVLA checks, for a further period of 2 years.

Local Government (Miscellaneous Provisions) Act - 1976 - DRIVER MN

The Head of Environmental Health Services submitted a report concerning a request from Private Hire Vehicle licence holder MN to be exempt from the requirement to display door signs and external private hire plates.  This request falls outside the Private Hire and Hackney Carriage Licensing Policy.

 

Consideration of this request was deferred by the Public Protection Committee on 10 April 2019 to allow the applicant to attend.  Driver MN attended the meeting and explained the business reasons for the request. 

 

Committee carefully considered the request and were mindful to grant the exemption only when driver MN was transporting Jazba Entertainments Ltd and at all other times to be plated and to display door signs.

 

Resolved:     That permission for the exemption from the requirement to display door signs and external private hire plates be granted when the vehicle was being used to transport Jazba Entertainments Ltd and at all other times to be plated and to display door signs.

Local Government (Miscellaneous Provisions) Act - 1976 - DRIVER MB

The Head of Environmental Health Services submitted a report concerning driver MB who had notified the Committee of a conviction within the time period set out in the Policy Guidance.  Driver MB attended the Committee and explained the circumstances of the offences.  Driver MB was reminded of two previous offences which were considered by the Committee (13/03/2019) at which time a written warning was given. It was explained to driver MB that the Committee took passenger and the safety of other road users very seriously and therefore a final written warning would be issued and if any further offences occurred the licence could be suspended or revoked.

 

Resolved:     That driverMB be given a final written warning.

Local Government (Miscellaneous Provisions) Act - 1976 - DRIVER HK

The Head of Environmental Services submitted a report concerning driver HK, a current Dual Driver.   Driver HK had failed to notify the Committee within the timescale set out in the guidance of a conviction which was relevant under the Council Policy. It was noted that driver HK had received a conviction for a previous offence which was also contrary to Council Policy.

 

Driver HK did not attend Committee and the Committee decided to deal with the application in the absence of the driver.

 

Resolved:     That driver HK be given a written warning.

The Head of Environmental Services submitted a report concerning driver SFA, a current Dual Hackney Carriage and Private Hire Drivers Licence Holder.  Driver SFA had failed to notify the Authority within the time period set out in the guidance of a conviction which was relevant under Council Policy.

 

Driver SFA attended the Committee and explained the background to the offence and stated that the first notification of the offence had not been received.  Committee noted that this was a first offence on an unblemished record.

 

Resolved:     That driver SFA be given a written warning
