Local Government (Miscellaneous Provisions) Act - 1976

The Committee considered a report regarding an application from Mr AK in respect of a new Dual Hackney Carriage and Private Hire Drivers licence.

 

MR AK addressed the Committee in respect of his programme of detoxification.

 

Resolved :    That the application by Mr AM be refused in line with the Councils Policy and guidelines together with the DVLA guidelines relating to drug addiction.

The Committee considered a report regarding Mr IB who had notified the Council of a conviction that fell within the Councils guidelines for the relevance of convictions.

 

Mr IB addressed the Committee, set out the circumstances of the conviction and explained that the correspondence had been sent to the company as the owners of the vehicle.  He also referred to attempts to contact the Authority.

 

In reaching the decision members of the Committee took into account a previous warning issued by the authority (1/11/2016) to Mr IB.

 

Resolved:     That, in view of the previous warning given, the Dual Hackney Carriage and Private Hire Vehicle Drivers licence held by Mr IB be suspended for a period of 2 weeks.

The Committee considered a report concerning a renewal vehicle application submitted from a company, CA UK, for a Private Hire vehicle licence.  The company had failed to comply with the Councils policy and guidelines relating to a failed vehicle test.

 

The applicant did not attend the Committee. In making its decision the Committee took into account the poor maintenance history of the vehicle and the Councils guidance in such matters.

 

Resolved:     That the application for the renewal of a Private Hire Vehicle Licence be refused.

Local Government (Miscellaneous Provisions) Act - 1976

Driver – Mr AL

The Committee considered a report regarding a new application for a Dual Hackney Carriage and Private Hire Vehicle Drivers licence from Mr AL.

 

Mr AL addressed the Committee and explained the fraudulent nature of the driving conviction and that the offence of resisting or obstructing a constable concerned a form which had not been completed due to a misunderstanding.

 

Resolved:     That Mr AL be granted a licence for a 12 month period.  If there are no further offences during this time MR AL could submit a full application to renew the licence and should there be any further convictions/or penalty points, this will be referred back to the Public Protection Sub Committee.

The Committee considered an application from Mr CH for a Dual Hackney Carriage and Private Hire Vehicle Drivers licence.

 

Mr CH provided evidence of his good driving history, and it was noted that the company had now displaying the policy and Council guidance prominently.

 

Resolved:     That the application submitted by Mr CH be approved and that a strong warning letter be sent to Mr CH setting out the need to comply with Policy and conditions of the licence.

Local Government (Miscellaneous Provisions) Act - 1976

The Committee considered a renewal driver application from Mr DEN.

 

Mr DEN addressed the Committee and explained the circumstances surrounding the offence.

 

Resolved:     (i)         That Mr DEN be granted a renewal of a drivers licence for a temporary period of 12 months subject to a condition that a copy of the licence issued by the DVLA on 30/12/18 be supplied and any conditions imposed reflected in the new licence issued by the Council.

 

 (ii)       That Mr DEN be sent a warning letter detailing the need to comply with the Policy and conditions of the licence and should there be any further convictions/or penalty points this will be referred back to the Public Protection Sub-Committee.
