Resolved:                 That the minutes of the meeting held on 1 November, 2016 be agreed as a correct record.

To resolve that the public be excluded from the meeting during consideration of the attached report, because it is likely that there will be disclosure of exempt information as defined in paragraphs 1, 2 and 7 in Part 1 of Schedule 12A of the Local Government Act 1972.

Prosecution proceedings for Failing to Comply with an Improvement Notice under The Housing Act 2004

The Committee considered a report regarding the instigating of legal proceedings for failing to comply with an Improvement Notice served under the Housing Act 2004.

The Committee considered a report regarding a new driver application for Mr MAK.

 

Mr MAK was not in attendance at the  meeting and had failed to attend on the previous two occasions.  For this reason, the Committee agreed to consider the item in his absence.

 

Resolved:     That, in view of the nature of the caution disclosed, the

Committee saw no reason to depart from its policy and having concluded that Mr MAK was not a fit and proper person to hold a dual driver’s licence, refused the application.

The Committee considered a report regarding a new driver application by Mr BAM.

 

Mr BAM was given the opportunity to address the Committee.

 

Resolved:     That, in view of the nature and severity of the offence disclosed,

the Committee saw no reason to depart from its policy and having concluded that Mr BAM was not a fit and proper   person to hold a dual driver’s licence, refused the application.

Mr HK was given the opportunity to address the Committee.

 

Resolved:     That the application submitted by Mr HK be approved for a

limited period of twelve months but that a written warning beissued as to future conduct.

Mr AA was given the opportunity to address the Committee.

 

Resolved:     That in view of the nature, number and severity of the convictions disclosed, the Committee saw no reason to depart from its policy and, having concluded that Mr AA was not a fit and proper person to hold a dual driver’s licence, refused the application.

The Committee considered a report regarding the outcome of prosecution proceedings against Mr Scott Houghton for failing to comply with a noise abatement notice.

 

Resolved:     That the report be received.

14.

Urgent Business

To consider any business which is urgent within the meaning of Section 100(B)4 of the Local Government Act.

Minutes:

The following item was considered as urgent business due to the timescales involved and the date of the next Public Protection Committee being 31 January, 2017.  In addition, the item will affect the Scale of Fees and Charges for 2017/18. 

15.

Update on the delivery of Safeguarding and Child Sexual Exploitation Training for taxi drivers licensed in the Borough

Minutes:

The Committee considered a report regarding the delivery of Safeguarding and Child Sexual Exploitation training for taxi drivers.

 

The terms were discussed at the Public Protection Committee meeting held on 3 November, 2015.

 

Resolved:     That approval be given to the following timescales and courses of action:

 

(i)            That all new applicants for a private hire or hackney carriage drivers’ licence be required to complete a safeguarding/child sexual exploitation course prior to their licence being granted.

(ii)          That all existing drivers be required to have completed the training by  28 February, 2017 or upon renewal of their licence – whichever is sooner.

(iii)         That should an existing taxi driver fail to attend a training session, without providing at least 24 hours’ notice, a fee of £35 will become payable.

(iv)         That any driver not attending a training session prior to 28 February, 2017 without good reason be advised that they may have their licence revoked.

(v)          That drivers be advised that refresher training sessions should be attended prior to any subsequent licence renewal.

(vi)          That a charge of £35 be made to new drivers for the provision of future safeguarding and CSE training.

(vii)        That all new and renewal drivers be required to produce a CSE training certificate from 28 February, 2017 as part of their application.
