DISCLOSURE OF EXEMPT INFORMATION

To resolve that the public be excluded from the meeting during consideration of the attached report, because it is likely that there will be disclosure of exempt information as defined in paragraphs 1, 2 and 7 in Part 1 of Schedule 12A of the Local Government Act 1972.

LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT - 1976 - DRIVER - Mr WUR

The Committee considered a report concerning Mr WURR who holds a Dual Hackney Carriage and Private Hire Driver Licence.  Mr WURR, who was not present at the meeting, notified the Council of a conviction which falls within the guidelines for the relevance of convictions.

 

The Committee considered the nature of the offence and the willingness of Mr WURR to disclose the information within the time period stated in the guidance.

 

Resolved:     That Mr WURR be sent a strongly worded warning letter; if there are further breaches of the policy the Council must be informed within 7 days and referred back to this Committee for further consideration of the licence.

LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT, 1976 - DRIVER - Mr MS

The Committee considered a report concerning Mr MS who holds a Dual Hackney Carriage and Private Hire Driver licence.  Mr MS had received a conviction which fell within the Councils guidelines for the relevance of convictions.  Mr MS was represented by Mr Khan, his solicitor who presented to the Committee the circumstances surrounding the case.

 

The Committee listened to the circumstances surrounding the offence and also considered the previous offences which Mr MS had committed within a relatively short period of time and asked for an assurance that Mr MS would improve on his driving record.  The Committee also recommended that Mr MS improve his understanding of the English Language. Mr MS was also requested to complete outstanding paperwork relating to his right to work documentation.

 

Resolved      That the licence of Mr MS be suspended for a period of 1 month; the return of his licence to be conditional upon the receipt of appropriate right to work documentation.

LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT - 1976 - DRIVER - Mr JI

The Committee considered a report concerning Mr JI who holds a current Hackney Carriage Drivers licence and had notified the Council of a conviction that falls within the Councils guidelines for the relevance of convictions.  Mr JI was represented by a friend, Mr Murdtaza Alam with Mr Tariq Mahmood, Chair of Hackney Carriage Association and Mr Abid Hussain as observers.

 

Mr Murdtaza presented the case on behalf of Mr JI and considered that previous convictions should not be taken into account.  The Committee questioned Mr JI on the circumstances surrounding the offences and clarified certain parts of his documentation.

 

Resolved      That Mr JI be sent a strongly worded warning letter and, should any further breaches of the Council policy occur, these must be notified to the Council within 7 days and referred back to this Committee to further consider the licence.

LOCAL GOVERNMENT ( MISCELLANEOUS PROVISIONS) ACT, 1976 - DRIVER - Mr FS

The Committee considered a report concerning an application from Mr FS for a Dual Hackney Carriage and Private Hire Vehicle Drivers licence whilst having a conviction that falls within the Councils guidelines for the relevance of convictions. Mr FS was accompanied by Mr Mohammed Zamir who presented the case.  In response to questions from the Committee Mr FS explained the circumstances surrounding the offence. After deliberation the Committee were mindful to grant a licence for a temporary period of time.

 

Resolved      That Mr FS be granted a licence for a period of 9 months and to return to Committee upon application for a further licence.
