DISCLOSURE OF EXEMPT INFORMATION

To resolve that the public be excluded from the meeting during consideration of the attached report, because it is likely that there will be disclosure of exempt information as defined in paragraphs 1, 2 and 7 in Part 1 of Schedule 12A of the Local Government Act 1972.

Resolved:-                That the public be excluded from the meeting during

consideration if the following matter because it is likely that there will be disclosure of exempt information as defined in paragraphs 1,2 and 7 contained within Part 1 of Schedule 12A of the Local Government Act, 1972

Local Government (Miscellaneous Provisions) Act - 1976

Driver – Mr AY

The Committee considered a report regarding an application for renewal of a Dual Driver’s Licence by Mr AY.

 

Mr AY was given the opportunity to address the Committee.

 

Mr AM stated that he was not the registered owner of the vehicle that he was driving at the time of the offence and had therefore not received any notification of any wrongdoing.  In addition he stated that there was fault with the speedometer which he had reported. Also, the stretch of road on which he was travelling went from 60mph to 30 mph within 200 yards.

 

Mr AY also stated that, when he was convicted of the offence, he did not think he had to report motoring convictions to the Council.

 

Mr AY stated that he was not carrying passengers at the time.

 

Resolved:     That the application submitted by Mr AY be approved for a

                        period of 6 months – from the expiry date of his current licence

(30 September, 2018), together with a written warning as to his future conduct.  Subject to there being no further incidents within the six months, Mr AY could then apply for a full licence.

Driver – Mr SM

The Committee considered a report regarding offences committed by Mr SM.

 

Mr SM was given the opportunity to address the Committee.

 

Mr SM stated that he had a drunken passenger in his vehicle who distracted him and he went over the centre line in the road.  This was witnessed by an unmarked police vehicle.

 

 

Resolved:     That Mr SM be issued with a strong written warning as to his

future conduct.

The Committee considered a report regarding offences committed by Mr SH.

 

Mr SH was given the opportunity to address the Committee. . 

 

Mr SH stated that he believed that he had contacted the office to notify of the offence.

 

When asked – Mr SH stated that he was not carrying passengers at the time nor was he in a licenced vehicle.

 

In a second incident, Mr SH had taken a fare out of the Borough in a Hackney vehicle and had been asked to collect them later.  However, the return journey would  have been acting as Private Hire.

 

Resolved:     That Mr SH be issued with a strong written warning as to his future conduct  and that he familiarise himself with the Council’s Policy and Guidelines in respect of taxi licensing.

Local Government (Miscellaneous Provisions) Act - 1976

Driver – Mr WA

The Committee considered a report regarding offences committed by Mr WA.

 

Mr WA was accompanied by a legal representative who addressed the  Committee. . 

 

Mr WA stated that he was not aware that he had to report motoring convictions to the Council.   Once he was made aware that this was a requirement, he did come in to report it .

 

When asked – Mr WA stated that he was not carrying passengers at the time nor was he in a licenced vehicle on one of the occasions.

 

Resolved:     That Mr WA’s current licence be revoked with immediate effect and replaced with a six month licence.  Subject to there being no further incidents within the six months, Mr WA could then apply for a full licence.  In addition, Mr WA was advised to re-familiarise himself with the Council’s Policy and Guidelines in respect of taxi licensing.

The Committee considered an application for a new Dual Carriage and Private Hire Vehicle Driver’s Licence Mr PFS.

 

Mr PFS was given the opportunity to address the Committee. . 

 

Mr PFS stated that he currently held a licence with Staffordshire Moorlands and also he transported children to school

 

He had committed the speeding offence on his way to his daughter who he believed to be in imminent danger.

 

Resolved:     That Mr PFS be granted a licence for a period of six months

together with a strong written warning as to his future conduct.

Subject to there being no further incidents within the six months, Mr PFS could then apply for a full licence.
