To resolve that the public be excluded from the meeting during consideration of the attached report, because it is likely that there will be disclosure of exempt information as defined in paragraphs 1, 2 and 7 in Part 1 of Schedule 12A of the Local Government Act 1972.

Local Government (Miscellaneous Provisions) Act - 1976

Driver – Mr DPS

The Committee considered an application for the renewal of a driver application from Mr DPS for a Dual Hackney Carriage and Private Hire Vehicle Drivers licence. Mr DPS was accompanied by his employer Mr C. The Committee took into consideration their own policy and, the officer’s report in addition to hearing from the applicant and the applicant’s employer.

 

Mr DPS stated that he had telephoned the Borough Council to inform of the offence but was not aware he needed to put it in writing, he was now aware of this. Mr C confirmed that all his drivers were now aware of this requirement.

 

As Mr DPS had taken corrective action and was clearly remorseful the Committee determined that they could depart from their policy and grant a licence for 12 months. If after that time no further offences had been committed the licence would be renewed administratively for the remaining 2 years. Should there be any further convictions/penalty points Mr DPS would be referred back to the Public Protection Sub Committee.

 

Resolved:     That Mr DPS be granted a licence for 12 months, if after this time Mr DPS has not committed any further convictions/or penalty points it will be renewed administratively for the remaining 2 years.

Local Government (Miscellaneous Provisions) Act - 1976

Driver – Mr NJT

The Committee considered an application from Mr NJT for a Dual Hackney Carriage and Private Hire Vehicle Drivers Licence whilst having a conviction that falls within the Councils guidelines for the relevance of convictions. In determining the application the Committee considered their policy and the officer’s report in addition to hearing from the applicant.

 

The applicant addressed the Committee with regard the background to the offence committed in June 2016.

 

The Committee accepted that the applicant had notified the Authority of the offence but considered that there was no reason to depart from their policy which was to refuse all applications involving violence for a period of at least 3 years from conviction.  The application was refused.

 

Resolved:     That the application be refused.

The Committee received an application from Mr RWP for a Dual Hackney Carriage and Private Hire Vehicle Drivers Licence whilst having a conviction that falls within the Councils guidelines for the relevance of convictions.

 

In determining the application the Committee considered their own policy, the officer’s report in addition to hearing from the applicant and his employer, Mr C.

 

After hearing from Mr RWP they considered that corrective action had now taken place and that they could depart from their policy.  They granted a licence for a period of 12 months.  After this time if no further offences had been committed the licence would be renewed administratively for the remaining 2 years. If there were any further convictions/or penalty points Mr RWP would be referred back to the Committee to consider his licence.

 

Resolved:     That Mr RWP be granted a licence for twelve months, if after this time Mr RWP has not committed any further offences the licence will be renewed administratively for the remaining 2 years.

The Committee considered an application from Mr ASO.  In determining the application the Committee considered their policy, the officer’s report and the Committee was addressed by Mr ASO. Mr ASO explained the background to the offences. 

 

The Committee determined that they had not heard anything to persuade them to depart from their policy and resolved to refuse the application.

 

Resolved:     That application from Mr ASO be refused.

Local Government (Miscellaneous Provisions) Act - 1976

Driver – Mr KD

The Committee considered an application from Mr KD who had informed the Committee of a Notification of a Conviction that fell within the guidelines for the relevance of convictions. In determining the application the Committee considered their policy, the officers report and Mr KD addressed the Committee.  Mr KD explained the background to the offence and Committee accepted the explanation which was supported by evidence and resolved to allow the licence to continue with a warning as to future conduct.

 

Resolved:     That Mr KD be allowed to continue with the licence, should there be any further convictions/or penalty points he be referred back to the Public Protection Sub Committee for further consideration.
