DISCLOSURE OF EXEMPT INFORMATION

To resolve that the public be excluded from the meeting during consideration of the attached report, because it is likely that there will be disclosure of exempt information as defined in paragraphs 1, 2 and 7 in Part 1 of Schedule 12A of the Local Government Act 1972.

Resolved:     That the public be excluded from the meeting during consideration of the following items because it is likely that there will be disclosure of exempt information as defined in paragraphs 1, 2 and 7 contained within Part 1 of Schedule 12A of the Local Government Act, 1972.

The Committee considered an application from Mr CSJAD for a Dual Hackney Carriage and Private Hire Vehicle licence. Mr CSJAD was accompanied by his solicitor who addressed the Committee.

 

In determining the application the Committee considered the policy, the officer’s report and the representation from the applicant’s solicitor and the applicant.

 

 

 

Resolved:     That Mr CSJAD be granted a licence for a 12 month period with a warning that if there were any further convictions/or penalty points the matter be referred back to this Committee for further consideration of his licence.

Local Government (Miscellaneous Provisions) Act - 1976

Driver – Mr AMS

The Committee considered an application from Mr AMS for a Dual Hackney Carriage and Private Hire Drivers Licence.  Mr AMS was accompanied by Mr Bashir Choudhry, Vice Chair of the Hackney Carriage Association who spoke on behalf of Mr AMS.

 

The Committee expressed concern that Mr AMS appeared to have little understanding of the requirements of the Policy and Mr AMS was asked to make every effort to read and understand the requirements of the Policy.

 

Resolved:     That Mr AMS be granted a Dual Hackney Carriage and Private Hire Drivers Licence for a period of 6 months with the condition that at that time he must come before the Sub-Committee to demonstrate his understanding of the driving conditions together with a warning that if Mr AMS incurred any further convictions/or penalty points Mr AMS must notify the Council in writing within 7 days and referred back to the Committee for further consideration of his licence.

The Committee considered a report concerning the notification of convictions that fall within the Councils guidelines for the relevance of convictions from Mr IK, a Private Hire Driver.  Mr IK was accompanied by Mr Yaqub who spoke on his behalf.

 

The Committee accepted the explanation given by Mr IK. Mr IK was reminded that his licence was due to expire on 22 December.

 

Resolved:     That no action be taken on this occasion.

The Committee considered an application from Mr AS, the holder of a current Dual Hackney Carriage and Private Hire Drivers Licence.  4 separate complaints had been made to the Council relating to Mr AS regarding overcharging and none use of the taxi meter.

 

In determining the outcome the Committee had regard to the policy, the officer’s report and the explanation given by Mr AS The Committee considered that the nature of the allegation was serious and the explanation given by Mr AS unsatisfactory.

 

Resolved:     That the licence held by Mr AS be revoked.

Resolved:     Due to absence of the applicant when the matter was due to be considered by the Committee, it was agreed that the report relating to Mr AR be deferred to the next appropriate meeting.
