Councillor Trevor Hambleton

Minutes:

A minutes silence was held in tribute to Councillor Trevor Hambleton who sadly passed away on 28 July.  Councillor Hambleton had been an active member of this committee.

Resolved:                 That the minutes of the meeting held on 19 June, 2017 be agreed as a correct record.

Disclosure of Exempt Information

To resolve that the public be excluded from the meeting during consideration of the attached report, because it is likely that there will be disclosure of exempt information as defined in paragraphs 1, 2 and 7 in Part 1 of Schedule 12A of the Local Government Act 1972.

Local Government (Miscellaneous Provisions) Act - 1976

Private Hire Vehicle

The Committee considered a report regarding a new vehicle application received from CAUL.

 

No representative was in attendance at the meeting.

 

Resolved:     That, in accordance with the council’s policy and guidelines,

the decision taken by the Head of Environmental Health and Head of Recycling, Waste and Fleet Services, to refuse the Private Hire Vehicle licence renewal application be endorsed.

The Committee considered a report regarding the renewal of a Dual Hackney Carriage and Private Hire Vehicle Drivers Licence by Mr WAR.

 

Mr WAR was given the opportunity to address the Committee.

 

Resolved:     That the application submitted by Mr WAR be approved but that a written warning be issued in respect of his future conduct.

Driver – Mr FB

The Committee considered a report regarding an incident involving Mr FB.

 

Mr FB was represented by his brother who addressed the Committee.

 

Resolved:     That in view of the nature of the conviction a written warning be issued as to Mr FB’s future conduct.

Local Government (Miscellaneous Provisions) Act - 1976

Driver – Mr MSM

The Committee considered a report regarding a number of incidents involving Mr MSM.

 

Mr MSM was accompanied by his brother who addressed the Committee.

 

Resolved:     That in view of the number, nature and severity of the convictions disclosed, the Committee saw no reason to depart from its policy and revoked Mr MSM’s Private Hire Driver’s Licence.

Local Government (Miscellaneous Provisions) Act - 1976

Mr ZUR was given the opportunity to address the Committee.

 

Resolved:     That in view of Mr ZUR’s conduct, his Private Hire Driver’s Licence be suspended for a period of two weeks and a written warning be issued as to his future conduct.

Mr FW was given the opportunity to address the Committee.

 

Resolved:     That the application submitted by Mr FW be approved  but that a written warning be issued as to his future conduct.

The Committee considered a report regarding a renewal driver application for a Dual Driver’s Licence by Mr ZA.

 

Mr ZA was accompanied by a legal representative who addressed the committee.

 

Resolved:     That the application submitted by Mr ZA be approved for a limited period of six months after which time, and subject to no further offences, Mr ZA could apply for a full licence.

ENVIRONMENTAL PROTECTION ACT 1990, SECTIONS 33 , 34 & 34(2A)

A report was submitted  advising the Committee of action taken in respect of a fly tipping offence within the Borough and seeking authorisation to institute legal proceedings.

 

Resolved:     That subject to review by the legal section, legal proceedings be instituted.
