Resolved:-                        That the minutes of the meeting held on 3 November, 2014 be agreed as a correct record.

Disclosure of Exempt Information

To resolve that the public be excluded from the meeting during consideration of the attached report, because it is likely that there will be disclosure of exempt information as defined in paragraphs 1, 2 and 7 in Part 1 of Schedule 12A of the Local Government Act 1972.

Resolved:-              That the public be excluded from the meeting during consideration if the following matter because it is likely that there will be disclosure of exempt information as defined in paragraphs 1,2, and 7 in Part 1 of Schedule 12A of the Local Government Act, 1972.

Local Government (Miscellaneous Provisions) Act - 1976

Private Hire Driver – Mr AH

Minutes:

A report was submitted regarding the recent removal of Hackney licence plates by Staffordshire Police from a vehicle licenced by this authority.  The owner of the vehicle had been requested to appear before the Committee.

 

Resolved:                         (i)       That Mr AH be issued with a strong written

warning.

(ii)       That Mr AH be given safety on how to maintain his vehicles to ensure that they are safe and reliable for use by the public.

(iii)      That further advice be given for the implementation of a checking system to ensure that similar problems do not occur in the future.

Local Government (Miscellaneous Provisions) Act - 1976

Private Hire Driver – Mr AB

The committee considered an application from Mr AB for the grant of a Private Hire Driver’s Licence.

 

Mr AB was given the opportunity to address the Committee.

 

Resolved:               (i)       That a licence be granted to Mr AB for

a period of twelve months.

(ii)       That, subject to there being no issues during the twelve month period, Mr AB’s licence be renewed.

Local Government (Miscellaneous Provisions) Act - 1976

Hackney Carriage Driver – Mr DG

The committee considered an application from Mr DG for the grant of a Hackney Carriage Driver’s Licence.

 

Mr DG also held a Private Hire Driver’s Licence issued by this authority.

 

Resolved:              (i)        That the application made by Mr DG for the grant

of a Hackney Carriage Driver’s Licence be refused

in accordance with the Council’s guidelines relating to the offence committed.

(ii)       That Mr DG be issued with a written warning for failing to notify the Council of the offence.

Hackney Carriage Driver – Mr EY

The committee considered an application from Mr EY for the grant of a Hackney Carriage Driver’s Licence.

 

A statement presented by Mr EY was read out.

 

Resolved:               That,  due to the nature of the offence and in accordance with the Council’s guidelines, the application be refused.

CLEAN NEIGHBOURHOODS AND ENVIRONMENT ACT 2005 -FIXED PENALTY NOTICES

Minutes:

A report was submitted to advise the Committee of action taken in respect of littering offences within the borough and to seek authorisation to institute legal proceedings against the Fixed Penalty Notice holders.

 

Resolved:       That legal proceedings be instituted in the relation to the cases

detailed.

A report was submitted to advise the Committee of the action taken in respect of Littering offences within the borough.

 

Resolved:    That the report be received.

AIR QUALITY MANAGEMENT AREAS FOR NEWCASTLE pdf icon PDF 1 MB

Minutes:

Consideration was given to a report advising Members of the findings of the statutory progress report in respect of the air quality in the Borough and the work required as a result.  A previous report had been received on 4 August 2014.

 

Members were advised that technical guidance was given to identify appropriate locations and vehicle counts were also carried out to assess the weight of the traffic.

 

Resolved:-              (i)       That an Air Quality Management Area be formally

designated by Order under the provisions of Section 83(1) of the Environmental Act 1995 for an identified area of Kidsgrove  (Order number 1) as detailed.

(ii)       That an Air Quality Management Area be formally designated by Order under the provisions of Section 83(1) of the Environmental Act 1995 for an identified area of Newcastle under Lyme Town Centre (Order number 2) as detailed.

(iii)           That an Air Quality Management Area be formally designated by Order under the provisions of Section 83(1) of the Environmental Act 1995 for an identified area of May Bank, Wolstanton and Porthill (Order number 4) as detailed.

(iv)          That an Air Quality Management Area be formally designated by Order under the provisions of Section 83(1) of the Environmental Act 1995 for an identified area of Little Madeley (Order number 3) as detailed.

(v)           That area specific Action Plans be developed to manage the Air Quality Management Areas within 12 months of the designation.
