 A report was submitted requesting the Committee to discuss and agree upon the consultation process for the Council’s Gambling Policy.

 

Under Section 349 of the Gambling act 2005, the Council had a statutory duty to review its Gambling statement as set out in the Gambling Policy before December 2015.

 

Resolved:

 

1.         That the Consultees for the Gambling Policy be agreed upon.

 

2.         That the Gambling Policy for Newcastle under Lyme be sent out for an 8 week consultation period.

 

3.         That any responses received to the consultation be considered by the Committee at the meeting to be held on 22nd October 2015 and that recommendations of this Committee to be included in the final report to Full Council.

 

4.         That the updated Policy be presented for approval to Full Council at its meeting on Wednesday 29th November 2015.

A report was submitted in relation to an application for a new premise licence for Whitmore Hall Estate. Representations had been received from Environmental Health on the basis that to grant the application would undermine the licensing objective relating to public nuisance. However following negotiations with the applicant and Staffordshire Police a set of conditions (Appendix A) had been agreed that would alleviate the concerns put forward by Environmental Health. A representation had also been received from an interested party which was attached at appendix B.

 

The Committee considered the application and listened to the representations put forward by the Police and Environmental Health.

 

Resolved:

 

That the application be granted with the conditions put forward by the Police and Environment Health with the amendment that:

 

·        Condition 23 should read:-

23. All children under 16 must be accompanied by a responsible adult to the event.

 

and

 

·        That the hours for (L) late night refreshment will be reduced to 07:00hrs - 23:30hrs each day, the (M) sale of alcohol on Friday, Saturday and Sunday to terminate at 23:30hrs and the hours for (A) plays, (B) films, (E) live music, (F) recorded music, (G) performance of dance, (H) anything similar to E, F, or G, (I) music making facilities, (J) dance facilities, (K) similar entertainment facilities to I or J, to terminate at 22:30hrs each day.

A report was submitted requesting the Committee to consider the consultation document from the Institute of Licensing regarding premise licence conditions.

 

Resolved:

 

a)         That in general the Committee were in agreement with the proposed conditions

 

b)         That a response be provided to the Institute of Licensing highlighting the specific comments made by the Committee which included the use of conditions to control when glasses were collected and bottles disposed of in licenced premises.
