Minutes:

To inform the Committee of the outcome of the appeal from the sub-committee’s decision to the Magistrates Court.

 

On 15 May 2012 a licensing sub-committee heard an application by Staffordshire County Council Trading Standards to review the premises licence for Rizwan News, 123 Knutton Lane.  The application set out a number of areas of concern relating to test purchase failures and the sale of alcohol and tobacco to minors. 

 

The appeal was heard before the Magistrates sitting at Fenton Magistrates Court on 18 July 2012 who dismissed the appeal.

 

Resolved:      That the report be received.

A report was submitted to allow the Committee to discuss and agree upon the consultation process for the Council’s Gambling Policy. Under Section 349 of the Gambling act 2005, the Council has a statutory duty to review its Gambling statement as set out in the Gambling Policy before December 2012.

 

 

Resolved:     (a)       That the Gambling Policy for Newcastle under Lyme be sent out for a 5 week consultation period.

 

(b)        That the Consultees for the Gambling Policy be as listed at Appendix B plus representatives of the Trade in the Borough.

 

(c)        That the documentation for the consultation be agreed as listed in the appendices.

 

(d)        That an additional meeting of this Committee be held on Thursday 8th November to consider any responses received to the consultation and to allow the recommendations of this Committee to be included in the final report to Full Council.

 

(e)        That the updated Policy be presentedfor approval to Full Council at its meeting on Wednesday 28th November 2012.
